Federal agency shares more details on Lake Clear arrest

LAKE CLEAR — Customs and Border Protection has released more information about the 30-mile high-speed chase that ended with a crash and an arrest in Lake Clear almost two weeks ago.

The chase on Feb. 28 ended in a crash near the south end of Upper Saranac Lake and did not result in any injuries. The driver fleeing New York State Police and CBP — El Salvador native Jose D. Rodriguez-Arriaga, 29, of Biddeford, Maine — was charged with third-degree unlawful fleeing a police officer, a misdemeanor, and is now in CBP custody.

On the day of the chase, a U.S. Border Patrol Agent attempted a vehicle stop in Westville, according to CBP. This was an area where three Mexican nationals had been apprehended around 45 minutes earlier, CBP said.

The man in the car identified himself both as being from Maine and as an El Salvadorian national, according to CBP.

In 2017, a man of the same name — Jose D. Rodriguez-Arriaga — from Portland, Maine was arrested for allegedly hitting a pedestrian with his car in Portland. He was 22 at the time. Reporting from Channel 8 WMTW at the time said that Rodriguez-Arriaga was driving without a license.

When BPA agents attempted to arrest him last month, he allegedly resisted arrest and physically assaulted one agent and fled the scene. CBP said the agent has since recovered.

CBP did not say whether they took up the chase in Westville but said they contacted local law enforcement and state troopers picked up the chase on the corner of state routes 30 and 458 in the town of Duane, nine miles north of Paul Smiths.

The chase reached a “high rate of speed” as it continued for 30 miles down state Route 30 through Paul Smiths, Lake Clear and Fish Creek, according to State Police Public Information Officer Brandi Ashley.

When the pursuit reached the corner of county Route 45, also known as Panther Mountain Road, Rodriguez-Arriaga attempted to turn on the sharp curve, Ashley said, and his SUV flipped.

According to CBP, his vehicle struck a set of mailboxes, which blew his tires, causing it to roll.

Rodriguez-Arriaga was not injured and declined medical attention from the Saranac Lake Volunteer Fire Department and Tupper Lake Volunteer Ambulance and Emergency Squad, according to Ashley.

He was processed by NYSP and turned over to CBP.

According to CBP, the man was identified as a suspect of human smuggling by U.S. Border Patrol and Homeland Security Investigation. CBP did not say whether Rodriguez-Arriaga was suspected of smuggling the three Mexican nationals apprehended in Westville.

Rodriguez-Arriaga was issued an appearance ticket for Brighton Town Court by State Police. His criminal charges and prosecution with CBP is still pending.

Ashley said State Police were notified CBP was looking for a blueish gray or grayish blue 2018 Dodge Durango. She said the SUV had Maine plates, a Texas registration and broken windows.
