Man charged with DWI twice on same road, same morning

LAKE PLACID — New York State Police charged a Keene Valley man with driving while intoxicated twice on the same road on the same morning.

State Police say they pulled over Brooks O. Bishop, 48, who was driving a 2014 BMW, at 2:43 a.m. Wednesday on state Route 73 in the town of North Elba after he nearly struck a State Police patrol car in another lane. He allegedly refused to take a breathalyzer test to determine his blood alcohol level. He was subsequently charged with misdemeanor DWI as well as failure to keep right, moving from a lane unsafely, depositing refuse on a highway and refusal to take a breath test, all infractions.

He was arraigned in the town of North Elba court and released on his own recognizance — until 6:40 a.m., when State Police stopped his car again on Route 73 for depositing trash on the highway.

Bishop was arrested after he allegedly refused to take a breathalyzer test again. He was additionally charged with DWI and second-degree aggravated unlicensed operation of a motor vehicle, both misdemeanors, as well as refusal to take a breath test and depositing refuse on a highway, both infractions.

He was arraigned in the town of North Elba court again and released on $3,000 cash bail.
