Crown Point man pleads guilty to shooting brother

ELIZABETHTOWN - A Crown Point man has admitted to fatally shooting his brother.

David R. Lang, 71, pleaded guilty Wednesday in Essex County Court to first-degree manslaughter in the shooting death of Russell Lang on June 19, 2012, county District Attorney Kristy Sprague said in a press release.

David Lang had been indicted on charges of second-degree murder and fourth-degree criminal possession of a weapon. His guilty plea to the manslaughter count, entered during a pre-trial conference Wednesday, satisfies those charges, Sprague said.

Lang had been scheduled to stand trial July 8. The DA said the court recently ruled that a 911 call placed by David Lang and statements he made to police would be admissible in the trial.

Lang shot his brother in the head with a 0.22 caliber rifle during an argument at the home they shared on Lake Road in Crown Point. Russell Lang died at Moses-Ludington Hospital in Crown Point. He was 63 years old.

Sprague called the guilty plea a "reasonable and fair disposition" given David Lang's age and his lack of prior criminal history.

"I met with his family members some time ago and discussed the disposition of a plea, and they were very amenable to putting this to rest without a lot of public display," Sprague said in the release. "It is a very difficult situation when one family member takes the life of another. They just didn't lose one brother that day, they lost both brothers. This plea will allow the family to try and now find some closure."

Sprague said Lang will waive his right to appeal as part of the agreement. She plans to ask Judge Richard Meyer for a 15-year prison term with post-release supervision.

Sentencing is scheduled for Aug. 8. Sprague said the judge has said he will impose no less than 10 years and no more than 15 years.

Lang was remanded to the Essex County Jail in Lewis on no bail, pending his sentencing. He is being represented by attorney Brandon Boutelle.
