Man found with 85 cartons of untaxed cigarettes

LONG LAKE - A man pulled over Wednesday was allegedly found with about 85 cartons of untaxed cigarettes in his vehicle.

Carl Smith, 53, of Fort Plain, was charged with criminal tax fraud in the fifth degree, a class A misdemeanor; possession of more than 10,000 untaxed cigarettes, a class E felony; speeding over 55 mph; and failure to keep right.

Police said they pulled Smith over for speeding and failing to keep right while driving his 2000 GMC Jimmy on state Route 30, and then they found the cigarettes.

Smith was released and scheduled to appear in town court at 7 p.m. April 11.
