SL board may ban tobacco in village parks

SARANAC LAKE - The village of Board of Trustees has scheduled a public hearing on a local law that would ban smoking and chewing tobacco in village parks.

The proposal bans the use of any tobacco product - including cigarettes, cigars, pipes, chew, snuff and any form of smokeless tobacco - in village parks, beaches and playgrounds. The law also prohibits the use of tobacco products within 25 feet of the entrance to a public playground or beach, and at any events held in public parks or areas in the village.

The public hearing is scheduled to take place at 7 p.m. Feb. 8 in the village offices.

The idea of banning smoking in village parks surfaced in August, when Trustee Jeff Branch said he had received complaints about people smoking in the William Morris Play Park and other public areas.

"I don't like smoking in public places," Branch, a former smoker, said at the time. "There's nothing more disruptive to me than to be walking down the street or in a public park and smell someone's cigarette smoke and see all the cigarette butts on the ground."

Since that time, the proposal has been reviewed by the village's Healthy Infrastructure Advisory Board, an eight-member committee formed last year to advise the village on issues related to parks, recreation, transportation and accessibility.

Trustee Susan Waters, a member of the advisory board, said the group thinks it's important to ensure village parks are clean and healthy for children and families. Margot Gold of Saranac Lake, an advisory board member who is also administrator of the North Country Tobacco Cessation Center, has spearheaded the proposal, Waters said at Monday night's village board meeting.

Trustee John McEneany said he was surprised at the scope of the proposed local law, specifically because it also applies to cigars, pipes and chewing tobacco in addition to cigarettes.

But he was more concerned about enforcement of the ban, if it's approved.

"Creating a law that's just on the books to make people feel good is not a good idea, as far as I'm concerned," McEneany said.

Community Development Director Jeremy Evans said the advisory board asked village Police Chief Bruce Nason about enforcement of a smoking ban in public parks.

"(Police) don't have the resources to be going around looking for people smoking in public parks," Evans said. "But it gives them a tool if someone is abusing it."

Approving the local law would also allow the village to put up signage informing the public that smoking is prohibited in parks, which could help resolve any issues, Evans said.

Water and sewer rate study

The board voted 3-2 to hire Pioneer Consulting of Woodbury, Conn. to conduct a water and sewer rate study. The firm's $15,000 bid was the lowest among the five companies that responded to a request for proposals.

The study is being performed as part of the village's plan to install water meters for 2,300 village water users who don't have them already. The village was awarded $1 million in federal stimulus funds for the project.

Village Manager Marty Murphy said Pioneer Consulting will prepare a billing analysis for water consumption, develop a revenue and expense budget and prepare rate structures for the village board to consider.

Mayor Tom Michael said the village's current rate structure, which includes a flat rate for using a minimum of 8,000 gallons, is counterproductive to conserving water.

"This will allow us to determine other sorts of rate structures and will tell us the impact of each one," he said.

"When we go to fully metered and people start conserving water, it's going to be beyond our capabilities in-house to determine what a fair rate is going to be on a completely metered system," Murphy added.

But Branch, who voted against the rate study along with McEneany, called it an "unnecessary expense."

"We've been producing and billing for water for 100 years now," Branch said. "To me it's a pretty simple equation."

Branch also said he believed the study was geared to determine how much the village can charge for water, instead of how much it should charge.

The funds to pay for the rate study will initially be taken from a village Community Development account. The cost will eventually be rolled into the village's financing for the water meter project, Murphy said.

Meetings to be taped

The board voted unanimously Monday to spend $1,550 to purchase and install video equipment to record village board meetings. The purchase includes microphones for the board table and one for the audience. The equipment will be installed by Pat Donnelly.

"Every week we'll have a recording of the meetings and it will play on channel 2 or 22," Michael said. "We'll have improved sound recording so people can actually hear the meeting."

The funds to purchase the video equipment will be taken out of the village clerk's budget line, said village Treasurer Paul Ellis.

A village resident had videotaped board meetings in the past and submitted the recordings to Time Warner Cable for broadcast, but there were problems with sound quality and that person is no longer recording village meetings.

Here is a news flash. The more water you waste, the more sewage you produce that needs processing. Even if you put clean water down the drain, it has to go through the sewage disposal plant. Meters are the smart way to go. Those that waste water with broken faucets and toilets will get the message quick when they get a bill for $2500 for a quarter instead of say $125. Let those wasting resources pay for it themselves.

Go ahead, smoke in your house and car and stink it up. But roll up your windows and keep your stink to yourselves. Don't your ciggie out the car window flicking ashes and outputting your stink, then littering butts anywhere and everywhere. The world is not the personal ashtray of selfish stinky smelly smokers.

Be careful...if you conserve to much water, your rates will have to increase to cover costs of running the water system...You are opening up yourselves for one big headache with those water meters....has anyone asked who will be responsible to repair or replace one ? I bet the way your village is set up, the home owner will cover all those costs...and what happens when you can't afford to fix a meter.....well the village will just estimate your usage high until you do fix it....how else can they make any money? Remember they can't work on private property so that leaves the public holding the bag once again. I feel sorry for a person who has to let their water run in the winter as well, but if you have to because a village water main is not deep enough and freezes start complaining now to have them lowered...after all it just seems to take so long to get things done over there.

Funny how they 'slipped' in the water issue. Nice- the distraction of a controversal issue superimposed on a real issue.

As far as smoking goes, the next thing they'll be telling you that you can't smoke in your own home or car- wait and see...

The real issue is the water, burried below the dstraction. Surrounded by hundreds of lakes and rivers- and we are 4 times- read this- 4 times the national average on water and sewer. Ask yourself-why is this? How can this be? Branch says that it is simple- we produce- we bill- but at 4 times the cost? Is this fair- is it realistic? An assessment of the current system is vital to not only bill accordingly- but to also find out what is wrong with the system. (Especially as the 'free' energy we create to pump the water in the 1st place is obviously not being credited to the 'payers') Also, encourage all involved to TAKE THE RECCOMENDATIONS of the professionals, instead of poo poo'ing and deciding that the "Town Fathers and Mothers" kn

Perhaps the village should also ban all diesel motor traffic within 1000' of all parks. The amount of emitted particulates is shocking. Perhaps we could train the geese to attack smokers! I feel sad for those who are so insecure in their lives they feel the need to legislate them.

Ahhhhhhhh Big Gov't again...Mr Branch says "There's nothing more disruptive to me than smelling smoke & seeing butts on the ground...blah blah blah..To me there's nothing more repulsive than a reformed smoker who now walks on water......Either make Smoking illegal!!!!....or pipe down!! Oooooops.......you can't make it illegal because if you did...who would pay for all those "special projects" that now are paid by the "Smoker's Tax" When will Gov't tell the people what kind of toilet paper we must use..Gov't has gotten way too big and we just made that clear with our election here in Ma...Oh & by the way..I am a former smoker..but I have never enforced my will on others..Back off!!

the police 'dont have the resources' my eye. They have the resources to sit in a parking spot and wait for speeders, dont they? Smoking probably kills as many people as speeding does. Ban it.

Hey JS, did you bother reading the article? The police said they don't "have the resources" to enforce the law. I agree smoking shouldn't be allowed but proper signage can be erected and enforced through peer pressure and disorderly conduct charges if necessary. More unenforceable legislation is not the answer.

The problem with the smoking ban is the fact that it can't be enforced, only selectively enforced which is a bad law. And then there is the inevitable lawsuit which the village will have to defend with taxpayer money. As far as the water meters go, anybody in this village who thinks their bill is going down due to conservation isn't drinking water. Bond payments, increased operating costs, and the inevitable doubling of pumping (energy) costs will offset household conservation.

Apparently people think it's easier to ban things these days rather than hope people could simply talk to each other. If a smoker in a park is bothering you, politely ask the person to move downwind, etc...is it too much for the smoker to politely respond? Next we'll be revisiting the noise ordinance, banning chainsaws and music alike within village limits. Please handle your own disputes in a polite and organized way and try to avoid these sweeping policies. (I am a smoker, but I admit banning smoking in public facilities was a brilliant move. There is no ability to resolve the dispute over secondhand smoke when one is trapped inside with smokers given the green light to huff away.)

why dont they put this smoking ban to a vote though i agree that smoking around kids and some adults is offensive what gives this board the right to ban smoking in places a taxpayer has the right to smoke its his or her right and like johnny said its outside this village board is sure getting cocky with what they feel they need to do

I agree with Jackk totally. The government has gotten way to intrusive on our own civil rights! Yes, ban it from schools and hospitals certainly..even state buildings. But to put a smoking ban on parks..outside..crazy!!!

Mayor Michael has the Galons for water meters wrong.... It is 8500 gals. per quarter! If there is restructuring of the rates you can bet they will skyrocket!!!!!! I myself use less than the amount allowed but I am sure others like to use more......... The Village will find out that when people are forced to use these meters,they will certainly use far less and that means nothing more than increases!!!!!!

I agree with this .... I am a reformed smoker myself (feb.7'th 1994 is the day i quit).... The health problems from this act is huge . Not only to those who smoke but some people that never smoked....... I agree with the parks and beach but If this law says "village property" That would mean the entire village and I do not agree with that......

While I agree that smoking is harmful and that I prefer to be places where people are not smoking, it has been shown that the public smoking bans have actually increased the exposure of low-socioeconomic status children (whose parents are more likely to smoke) to second hand smoke b/c now their parents just smoke more indoors. And the smoking bans were not enacted with any similar focus on lowering the cost of smoking cessation aids. Even if I believe cold turkey quitting is the most effective, it doesn't make any sense for the aids to stop smoking to cost so much more than cigarettes themselves.

The ordinance only applies to specific parks and beaches that are Village property and that are places where children congregate - William Morris Park, Ampersand Park, Lake Colby Beach, Mt. Pisgah, and the Skate Park.
