Bail set at $100,000; Russian consulate hires local lawyer

LAKE PLACID - A Russian figure skater in town to compete in this past weekend's Skate America event was arrested for allegedly stealing a car from a local garage and driving drunk. But his attorney says police may have got it wrong.

Andrei Lutai, a 23-year-old from St. Petersburg, Russia, is currently in the Essex County Jail in Lewis facing charges of third-degree grand larceny, third-degree criminal possession of stolen property, third-degree unauthorized use of a vehicle and aggravated driving while intoxicated.

Lutai allegedly stole a 2008 Chevrolet Impala parked along Main Street next to Central Garage around 10:45 p.m. Sunday. Lake Placid Police Sgt. Carol Hayes said employees of the business witnessed the theft and immediately called police. One employee got into a vehicle and followed Lutai.

Within five minutes, police spotted the Impala and pulled Lutai over. He was found to be intoxicated and arrested, Hayes said.

Police initially had difficulty communicating with Lutai because of the language barrier, Hayes said. A coach at the U.S. Olympic Training Center who speaks Russian was brought in to serve as a translator.

Lutai was arraigned before village Justice Margaret Dorn and remanded to the Essex County Jail in Lewis in lieu of $100,000 cash bail. He's scheduled to appear in village court again at 7 p.m. Wednesday.

Hayes said she didn't know why Lutai stole the Impala. The keys had been left inside the vehicle.

"We're not treating this differently than any other arrest," Hayes said. "There's been a lot of questions on this, and the phone has been ringing. We treat everybody as fairly as we possibly can."

Jay Strack, who works at Central Garage and whose family owns it, said the Impala belongs to a customer and was parked along the road at the time it was allegedly stolen. Strack said he didn't know any more about what happened.

Brian Barrett of Lake Placid is serving as Lutai's defense counsel. He said he was contacted by the Russian Consulate because he's representing a Russian boxer who's facing federal drug conspiracy charges.

Barrett said he expects Lutai's case to be resolved quickly because he said there were conflicting reports from witnesses about whether Lutai was the one who stole the vehicle and was behind the wheel. He said the Impala was already pulled over, next to the Econo Lodge on Cascade Road, when police showed up.

"I don't believe he was properly identified and I don't believe he was actually witnessed by police driving the motor vehicle," Barrett said. "At the time of the arrest, there were also serious communication problems with Mr. Lutai."

Barrett said he's had to use a translator - a Russian coach - to communicate with Lutai, who he said should be presumed to be innocent until proven otherwise.

"He's very disappointed," Barrett said. "He's a world class athlete who has been accused of some very serious crimes. Fortunately nobody was hurt. Even figure skaters, on occasion, make mistakes."

Lutai finished 10th in the men's competition at Skate America. Barrett said the rest of the Russian team left Lake Placid on Monday.

Considered a strong contender for the Russian Olympic team, Lutai placed 10th at last year's world championships and finished third at the Russian national figure skating championships the same year.

I was wondering if my post would elicit a response from the friends of Central Garage, but I didn't think it would be a biography. Every citizen in America has been watching the way politics works to benefit entitled families, are we to assume successful locals have a special gene that makes them immune to these human traits? Sometimes, when social climbing public servants are in a hurry to curry favor with powerbroking families like the Stracks, they act precipitiously without considering the full ramifications. In this case, it looks like the charges and bail were excessive. Today, people are sensitive to the appearance of impropriety. Maybe I assume too much, or maybe the statements I made regarding the Strack Family, can be attributed to every town in America. Either way, it's time for it to become part of the discussion. It isn't the first North Country drunken car theft, but $100,000 bail when he found keys in the car might be. It's like swatting a fly with a Howitzer.

Interesting. The guy broke the law, took something that didn't belong to him, keys or no keys. Had he entered an unlocked house, he would still be trespassing, right? I wonder what the punishment is in Russia, if I were to do the same? Did he even know where he was going, if he was black out drunk? Glad I didn't come across him. Being drunk doesn't make it right. If a local had done the same they'd be in the same predicament. Let him sit in jail. If you're sitting behind the wheel of a car, keys in the ignition, it's pretty likely you put that car where it was found - wow, stupid comments by his legal counsel as well.

The keys were in the garage, the guy found the second set in the car that the customer had left in the car, Central Garage had no idea there was a second set in the car. This is the best part about living LP everyone thinks that people who have money get away with crap and how come Strack has all he has, well let me let you in on a little secret people, Jerry Strack is where he is today because of where he came from, that place was living with a family of 9 kids,he worked selling papers, changing tires to buy his first car,he caddied at age 10.He had his own bike shop when he was 12 til about 16.Started his own business and has made it into what it is today. His wife/kids helped him get this far w/lots of long nights, lots of late dinners, lots of missed ball games for his kids, lots of time lost when he drove to Vermont to see his daughter in Vermont after surgery all the time.Until you walked a day in this man's shoes or his family's,please don't assume you know it all. Thank you!

A few of you don't have your facts straight with this, it has nothing to do with do the customers cars getyting or not getting tickets especially when the majority of the cars are parked on Central Garage's personal lot for their empl.oyees and customers, yes a few do get parked on the street but are picked up shortly after they are done. The point is that it has nothing to do with the kid going for a joy ride.

Also Jerry Strack never resided over the Police Dept, it was his brother T James Strack (May He Rest In Peace) who was Mayor of Lake Placid and looked after or over the Police Dept as their Commissioner. People get yu facts straight before you go throwing around crap that yopu hjave not idea about! Get you facts straight before you go writing crap you have no idea about!

This young fellow came to town to skate for his country and somehow got drunk or had his drink spiked and then thought he might get a ride by jumping in a car and taking it down to thr training center where he was probably staying. He was caught by the people he took th3e car from, they got him to pull over bvy the Econo Lodge and no one got hurt thank God! Yes, the stealing of the car was wrong and the drunk driving was really wrong, but no one got hurt and as far as I know the family at Central Garage wants this all dropped, it is done and over with, yes the drunk driving charge needs to be addressed but the stealing of the car was just a stupid stunt and just should be thrown out anbd let the kid deal with the drunk driving part of things and please leave the family at Central Garage along they got their car back, it wasn't damaged, no one got hurt, just let it go and let the kid deal with just the drunk driving charge, that makes better news than dragging the family at Central Gar

Jeeesh alcohol is a bad drug! If that russian man was smoking cannabis he would have stayed home, watched a movie, ate some chips, and went to sleep.

The $100,000 bail was because he had the audacity to take advantage of Central Garages slack attitude toward the automobiles they are entrusted with. An attack on the credibility of Central Garage, is not allowed and must be punished severely. Wasn't it Central Garage's Jerry Strack who presided over the Police force and sold them vehicles for decades? The $100,000 bail isn't because of the crime, it's due to who he committed the crime against. Don't you guys know anything about justice in banana republics? If he did it to a victim class family, it wouldn't make the papers. Since it's Central Garage, Just-Us will be swift and merciless.

This guy had to be black out drunk to do something like this. Regardless, he needs to be trested the same as all of us. The other fact that he was not driving the car if proving, he is still at fault by assosiation. And he is a flight risk also so the high bail is justifiable.

Brings to mind an incident that occurred during the 1980 Winter Olympics, involving a U.S.A. athlete and a beer delivery truck that was 'borrowed' in Lake Placid.

Hmm .... :)

when an american gets into trouble overseas they certainly don't get any breaks........if a child had been run over he could be dead the same as if an american did it.....the amount of bail is set by how high a flight risk he is. with a passport in hand and tickets ready i would say he is a high flight risk.............congratulations to the lppd and to the judge

I don't see any reason why a man who's on the front page of the paper in a fantastic ensemble of tight pants and pink gloves would have a hard time in jail.

If he is any good, keep him here, if Shasha Cohen can come back to the amateur ranks after skating pro, a convicted felon should be able to compete, heck the US could use him....just like Michael Vick, and others

"He's very disappointed," Barrett said. "He's a world class athlete who has been accused of some very serious crimes. Fortunately nobody was hurt. Even figure skaters, on occasion, make mistakes." Wow...talk about throwing your client under the bus....

The only other World class athlete with worst luck.......wait for it....OJ Simpson.
